NOTICE IS HEREBY GIVEN Pursuant to an Order Rescheduling August 1, 2011 Foreclosure Sale dated September 20, 2012, and entered in Case No. 09-CA-070373 of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida in which The Bank of New York Mellon f/k/a The Bank of New York, as Trustee on Behalf of the Certificateholders of Cwabs, Inc., Asset-Backed Certificates, Series 2004-13, is the Plaintiff and Julie Howell, Steven Howell, Cape Coral Housing Rehabilitation and Development Corporation, City of Cape Coral Florida, Current Tenants, Hickey Excavation, Inc., Mortgage Electronic Registration Systems, Inc., are defendants, I will sell to the highest and best bidder for cash in/on www.lee.realforeclose.com in accordance with chapter 45 Florida Statutes, Lee County, Florida at 9:00 A.M. on the 19 day of November 2012, the following described property as set forth in said Final Judgment of Foreclosure:
all that parcel of land in lee county, state of florida, as more fully described in deed book 3725, page 2856, id#32-43-24-C1-02179, 0360, being known and designated as lot 36 and 37, block 2179, cape coral, unit 33, filed in plat book 16, page 40-61. By fee simple deed from department of housing and urban development as set forth in deed book 3725, page 2856 dated september 9, 2002 and recorded september 11, 2002, lee county records, state of florida. the coverages provided by the closing protection letter printed in the inside cover of this Commitment are extended to the proposed insured lenders identified herein and to their borrower as applicable under rule 4-186, florida administrative code.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
