NOTICE IS HEREBY given pursuant to an Order or Final Judgment of Foreclosure dated September 28, 2010, and entered in Case No. 36-2009-CA-056175 of the Circuit Court of the 20th Judicial Circuit in and for Lee County, Florida, wherein National City Mortgage a Division of National City Bank, is the Plaintiff and Richard M. Moreno; Virginia Lopez-Moreno; and Darrell C. Rumley, are the Defendants, the Clerk of Court will sell to the highest and best bidder for cash by electronic sale at www.lee.realforeclose.com beginning at 9:00 a.m. Eastern Time, on October 22, 2012, the following described property set forth in said Order or Final Judgment, to wit:
LOT(S) 21 AND 22, BLOCK 2935, UNIT 42, CAPE CORAL SUBDIVISION, ACCORDING TO THE PLAT THEREOF, RECORDED IN PLAT BOOK 17, PAGE(S) 32 THROUGH 44, OF THE public records of lee county, florida.
if you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk of court no later than 60 days after the sale. if you fail to file a claim, you will not be entitled to any remaining funds. after 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
