NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure filed March 20, 2013, and entered in Case No. 2012 CA 004801, of the Circuit Court of the 12th Judicial Circuit in and for MANATEE County, Florida. DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR AMERICAN HOME MORTGAGE ASSETS TRUST 2007-5, MORTGAGE-BACKED PASS-THROUGH CERTIFICATES SERIES 2007-5 is Plaintiff and GERALD S. GERAGHTY; JUDITH A. GERAGHTY; UNKNOWN PERSON(S) IN POSSESSION OF THE SUBJECT PROPERTY; UNITED STATES OF AMERICA DEPARTMENT OF THE TREASURY; are defendants. The Clerk of Court will sell to the highest and best bidder for cash by electronic sale at: www.manatee.realforeclose.com, at 11:00 A.M., on the 24th day of April, 2013, the following described property as set forth in said Final Judgment, to wit:
LOT 16 OF CIPRIANI'S SECOND SUBDIVISION, AS PER PLAT THEREOF RECORDED IN PLAT BOOK 11, PAGE 72, OF THE PUBLIC RECORDS OF MANATEE COUNTY, FLORIDA;
LESS AND EXCEPT THE FOLLOWING:
COMMENCE AT THE SOUTHEAST CORNER OF LOT 16 OF CIPRIANI'S SECOND SUBDIVISION, AS RECORDED IN PLAT BOOK 11, PAGE 72, OF THE PUBLIC RECORDS OF MANATEE COUNTY, FLORIDA (ALSO BEING THE MOST NORTHERLY CORNER OF LOT 17 OF SAID SUBDIVISION); THENCE S 53°37'30” W, ALONG THE COMMON LINE BETWEEN LOTS 16 AND 17, A DISTANCE OF 104.22 FEET FOR A POINT OF BEGINNING, THENCE CONTINUE S 53°37'30” W, ALONG SAID COMMON LINE, A DISTANCE OF 32.92 FEET TO THE SOUTHWEST CORNER OF LOT 16 (ALSO BEING THE NORTHWEST CORNER OF LOT 17); THENCE N 01°42'30” W, ALONG THE WEST LINE OF LOT 16, A DISTANCE OF 24.15 FEET; THENCE S 80°22'30” E, 27.61 FEET TO THE POINT OF BEGINNING.
A person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim with 60 days after the sale.
