NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure filed March 18, 2013, and entered in Case No. 2012 CA 000190 NC, of the Circuit Court of the 12th Judicial Circuit in and for SARASOTA County, Florida. FV-I, INC. IN TRUST FOR MORGAN STANLEY MORTGAGE CAPITAL HOLDINGS LLC is Plaintiff and DAVID C. KIS; SONYA KIS; UNKNOWN PERSON(S) IN POSSESSION OF THE SUBJECT PROPERTY; THE COLONY AT SABAL TRACE CONDOMINIUM ASSOCIATION, INC.; GMACB ASSET MANAGEMENT, LLC F/K/A GMACB ASSET MANAGEMENT CORP.; are defendants. The Clerk of Court will sell to the highest and best bidder for cash by electronic sale at: www.sarasota.realforeclose.com, at 9:00 A.M., on the 23rd day of April, 2013, the following described property as set forth in said Final Judgment, to wit:
UNIT 102, BUILDING 5770, THE COLONY AT SABAL TRACE, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM RECORDED IN OFFICIAL RECORDS INSTRUMENT #2005115527, AS AMENDED IN OFFICIAL RECORDS INSTRUMENT #2005132220, AND ACCORDING TO CONDOMINIUM BOOK 37, PAGES 49 THROUGH 49G, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO.
A person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
