NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale dated the 28th day of March 2013, and entered in Case No. 48-2008-CA-002752, of the Circuit Court of the 9TH Judicial Circuit in and for Orange County, Florida, wherein WELLS FARGO BANK NATIONAL ASSOCIATION, AS TRUSTEE FOR STRUCTURED ASSET MORTGAGE INVESTMENTS II INC., BEAR STEARNS MORTGAGE FUNDING TRUST 2006- AR5 MORTGAGE PASS THROUGH CERTIFICATES, SERIES 2006- AR5 is the Plaintiff and TIMOTHY S. PETERS A/K/A TOMOTHY S.PETERS, MORTGAGE ELECTRONIC REGISTRATION SYSTEMS INCORPORATED AS NOMINEE FOR SUNSET INTERNATIONAL MORTGAGE, INC, JANE DOE, JOHN DOE and UNKNOWN SPOUSE OF TIMOTHY S. PETERS A/K/A TOMOTHY S. PETERS IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The foreclosure sale is hereby scheduled to take place on-line on the 30th day of May 2013 at 11:00 AM at www.myorangeclerk.realforeclose.com. The Orange County Clerk of Court shall sell the property described to the highest bidder for cash after giving notice as required by section 45.031, Florida statutes, as set forth in said Final Judgment, to wit:
LOT 136, VISTAS AT PHILLIPS COMMONS, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 61, PAGES 93 THROUGH 97, INCLUSIVE OF THE PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
