NOTICE IS HEREBY GIVEN pursuant to a Final Judgment filed December 28, 2012, entered in Civil Case No.: 36-2012-CA-050206, of the Circuit Court of the TWENTIETH Judicial Circuit in and for LEE County, Florida, wherein BANK OF AMERICA, N.A., SUCCESSOR BY MERGER TO BAC HOME LOANS SERVICING, LP F/K/A COUNTRYWIDE HOME LOANS SERVICING LP is Plaintiff, and BARBARA P. HARRELL; UNKNOWN SPOUSE OF BARBARA P. HARRELL; UNKNOWN TENANT #1; UNKNOWN TENANT #2; ALL OTHER UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER, AND AGAINST A NAMED DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAME UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS, are Defendant(s).
LINDA DOGGETT, the Clerk of Court shall sell to the highest bidder for cash online at www.lee.realforeclose.com at 9:00 a.m. on the 29thday of April, 2013 the following described real property as set forth in said Final Summary Judgment, to wit:
BEGINNING AT THE NORTHWEST CORNER OF THE SE 1/4 OF SECTION 4, TOWNSHIP 44 SOUTH, RANGE 24 EAST, THENCE EAST A DISTANCE OF 1255 FEET, MORE OR LESS, TO WESTERLY SIDE OF BARRET ROAD; THENCE SOUTHEASTERLY ALONG THE WESTERLY SIDE OF SAID BARRETT ROAD A DISTANCE OF 341 FEET; THENCE WEST A DISTANCE OF 500 FEET TO THE POINT OF BEIGINNING OF THE LAND HEREBY CONVEYED; THENCE CONTINUE ALONG THE SAME LINE A DISTANCE OF 254 FEET; THENCE SOUTHEASTERLY AND PARALLEL WITH THE WESTERLY SIDE OF SAID BARRETT ROAD A DISTANCE OF 170.7 FEET; THENCE EASTERLY A DISTANCE OF 254 FEET; THENCE NORTHWESTERLY AND PARALLEL WITH THE WESTERLY SIDE BARRETT ROAD TO THE POINT OF BEGINNING.
AN EASEMENT FOR ROAD PURPOSES FOR INGRESS AND EGRESS OVER AND ACROSS THE NORTH 15 FEET OF THE FOLLOWING DESCRIBED LANDS:
BEGINNING AT THE NORTHWEST CORNER OF THE SOUTHEAST QUARTER (SE 1/4) OF SECTION 4, TOWNSHIP 44 SOUTH, RANGE 24 EAST,
THENCE EAST A DISTANCE OF 1225 FEET, MORE OR LESS, TO THE WESTERLY SIDE OF BARRETT ROAD; THENCE SOUTHEASTERLY ALONG THE WEST SIDE OF SAID BARRETT ROAD A DISTANCE OF 341 FEET; THENCE WEST A DISTANCE OF 250 FEET TO THE POINT OF BEGINNING OF THE LAND HEREIN DESCRIBED; THENCE CONTINUE WEST ALONG THE SAME LINE A DISTANCE OF 250 FEET; THENCE SOUTHEASTERLY PARALLEL TO BARRET ROAD A DISITANCE OF 170 FEET; THENCE EAST A DISTANCE OF 250 FEET; NORTHWESTERLY PARALLEL WITH BARRETT ROAD, A DISTANCE OF 170 FEET TO THE POINT OF BEGINNING.

If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
