NOTICE IS HEREBY given pursuant to an Order filed March 28, 2013, and entered in Case No. 36-2009-CA-055347 of the Circuit Court of the 20th Judicial Circuit in and for Lee County, Florida, wherein NATIONAL CITY BANK SUCCESSOR BY MERGER TO NATIONAL CITY MORTGAE CO., is the Plaintiff and Adam S. Mears; Lisa J. Mears; Timberwalk at Three Oaks Homeowners' Association, Inc.; Three Oaks I Master Association, Inc.; Chevy Chase Bank, F.S.B.; and Current Tenants(s), are the Defendants, the Clerk of Court will sell to the highest and best bidder for cash by electronic sale at www.lee.realforeclose.com beginning at 9:00 a.m. Eastern Time, on April 29, 2013, the following described property set forth in said Order or Final Judgment, to wit:
LOT 4, BLOCK E, TIMBERWALK AT THREE OAKS, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 81, PAGES 65 THROUGH 70, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
if you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk of court no later than 60 days after the sale. if you fail to file a claim, you will not be entitled to any remaining funds. after 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
