NOTICE IS HEREBY GIVEN pursuant to an Agreed Final Judgment of Foreclosure filed April 4, 2013, entered in Civil Case No. 12-CA-050968 of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida wherein IBERIABANK, a Louisiana bank, is the Plaintiff, and MERLIN REALTY I, LLC, a Florida limited liability company; RICHARD DRATH, Individually; PROVINCE PARK HOMEOWNERS ASSOCIATION, INC., a Florida not for profit corporation; and GREENS EDGE AT PROVINCE PARK CONDOMINIUM ASSOCIATION, INC., a Florida not for profit corporation, and all parties claiming interest by, through, under or against any defendant named herein, are the Defendants.
The Lee County Clerk of Court will sell to the highest bidder for cash, via Internet via Internet auction sale at www.lee.realforeclose.com at 9:00 a.m., in accordance with section 45.031, Florida Statutes, on May 6, 2013, the following described property, as set forth in said Agreed Final Judgment of Foreclosure, to wit:
Units 101, 102, 201 and 301, Building 11, Greens Edge At Province Park Condominium, a Condominium, according to the Declaration of Condominium thereof, as recorded in Official Records Instrument Number 2009000005229, of the public records of Lee County, Florida, and all amendments thereto, together with its undivided share in the common elements.
The property is located in Lee County at 4536 Dalmahoy Court, Units 101, 102, 201, 301, Ft. Myers, Florida 33916.
Together with all rights, easements, appurtenances, royalties, mineral rights, oil and gas rights, all water and riparian rights, wells, ditches and water stock, crops, timber, all diversion payments or third party payments made to crop producers and all existing and future improvements, structures, fixtures, and replacements that may now, or at any time in the future, be part of the real estate described (all referred to as Property).
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THIS SALE, YOU MUST FILE A CLAIM WITH THE CLERK NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
