NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 8th day of April, 2013, and entered in Case No. 58 2008 CA 018808 NC, of the Circuit Court of the 12TH Judicial Circuit in and for Sarasota County, Florida, wherein BANK OF AMERICA, N.A. is the Plaintiff and JEREMY J. GARBACIK A/K/A JEREMY GARBACIK; FAIRWAY OAKS CONDOMINIUM, INC.; TANYA M. GARBACIK; UNKNOWN TENANT(S); IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.sarasota.realforeclose.com at, 9:00 AM on the 14th day of May, 2013, the following described property as set forth in said Final Judgment, to wit:
UNIT 133, FAIRWAY OAKS, (FKA PARTICULARLY 72, PHASE 3), A CONDOMINIUM ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, RECORDED IN OFFICIAL RECORDS BOOK 915, PAGE 837, AND AMENDMENTS THEREOF, INCLUDING RESTATED DECLARATION RECORDED IN OFFICIAL RECORDS BOOK 2164, PAGE 2016, AND AS PER PLAT THEREOF, RECORDED IN CONDOMINIUM BOOK 5, PAGE 7, AND AMENDMENTS THEREOF, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
