Notice is hereby given to GISELA GARCIA-LEYVA, an individual; GISELA-GARCIA-LEYVA, M.D., P.A., a Florida corporation; OPTION CENTER, Inc., a Florida corporation; and UNKNOWN TENANT-IN-POSSESSION, and all parties having or claiming to have any right, title, or interest in the property described herein that SUNTRUST BANK has filed a mortgage foreclosure proceeding against the aforementioned parties bearing the case style SUNTRUST BANK, Plaintiff vs. GISELA GARCIA-LEYVA, et al., Case No. 13-CA-002850, in the Circuit Court of the Thirteenth Judicial Circuit in and for Hillsborough County, Florida.
The Plaintiff seeks to foreclose on the property containing the following description:
Lots 1 and 6, A.D. Daniels Resubdivision of Lot 16 Block 5, Swastika Subdivision, according to the map or plat thereof, as recorded in Plat Book 10, Page(s) 7, of the Public Records of Hillsborough County, Florida.
TOGETHER WITH:
All of the Debtor's right, title and interest, whether now owned or hereafter existing or acquired and wherever located, including but not limited to, all fixtures, appliances, apparatus, equipment, furnishings, heating and air conditioning equipment, machinery and articles of personal property and replacement thereof (other than those owned by lessees of said real property) now or hereafter affixed to, attached, to, placed upon, or used in any way in connection with the complete and comfortable use, occupancy, or operation of the said real property, all licenses and permits used or required in connection with the use of said real property, all leases and sales contracts of said real property now or hereafter entered into and all right, title and interest of Gisela Garcia-Leyva thereunder, including without limitation, cash or securities deposited thereunder pursuant to said leases or sales contracts, and all rents, issues, proceeds, and profits accruing from said real property and together with all proceeds of the conversion, voluntary or involuntary of any of the foregoing into cash or liquidated claims, including without limitation, proceeds of insurance and condemnation awards.
The mortgage foreclosure proceeding includes counts for reformation of mortgage, foreclosure of mortgage as reformed, breach of promissory note, and breach of guarantees.
