NOTICE IS HEREBY GIVEN pursuant to an Order or Final Judgment of Foreclosure dated July 22nd , 2013, and entered in Case No. 2010-CA-002802-NC of the Circuit Court of the 12TH Judicial Circuit in and for SARASOTA County, Florida, wherein BANK OF AMERICA, N.A., SUCCESSOR BY MERGER TO BAC HOME LOANS SERVICING, LP, FKA COUNTRYWIDE HOME LOANS SERVICING, LP is the Plaintiff and , JOSEFINA CHAVEZ; and MIGUEL GERVACIO; and AQUA FINANCE INC are the Defendants, the clerk shall sell to the highest and best bidder for cash www.sarasota.realforeclose.com, the Clerk's website for on-line auctions, at 9:00 A.M. on the 20th day of November, 2013, the following described property as set forth in said Order of Final Judgment, to wit:
EAST 95 FEET OF LOT 1, BLOCK B, REPLAT OF MELODY HEIGHTS, UNIT NO. 1, ACCORDING TO THE MAP OR PLAT THEREOF, RECORDED IN PLAT BOOK 6, PAGE 98, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK OF COURT NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
