RE-NOTICE IS HEREBY GIVEN pursuant to an Order Granting Plaintiff's Motion to Reschedule Foreclosure Sale filed July 30, 2013 and entered in Case No. 09-CA-052721 of the Circuit Court of the TWENTIETH Judicial Circuit in and for LEE COUNTY, Florida, wherein GMAC MORTGAGE, LLC, is Plaintiff, and KENNETH MICHAEL WILLIAMS, JR, et al are Defendants, the clerk will sell to the highest and best bidder for cash, beginning at 9:00 am at www.lee.realforeclose.com, in accordance with Chapter 45, Florida Statutes, on the 29 day of August, 2013, the following described property as set forth in said Lis Pendens, to wit:
LOT 108 UNIT 1 MCGREGOR ISLES, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 12, PAGE 24; AND LOT 107 AND A PORTION OF LOT 106, UNIT 2, MCGREGOR ISLES, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 12, PAGE 140, IN THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA, SAID PORTION OF LOT 106,UNIT 2, DESCRIBED AS FOLLOWS: BEGINING AT THE NORTHEAST CORNER OF AFORESAID LOT 106, THENCE BY A CURVE ALONG THE NORTH LINE OF AFORESAID LOT 106 DEFLECTING TO THE RIGHT A DISTANCE OF 7.86 FEET. SAID CURVE HAVING A RADIUS OF 40.0 FEET AND A CHORD THAT BEARS SOUTH 83 DEGREES 21 MINUTES 10 SECONDS WEST, A DISTANCE OF 7.85 FEET; THENCE SOUTH 88 DEGREES 59 MINUTES WEST, ALONG THE NORTH LINE OF AFORESAID LOT 106, A DISTANCE OF 10.70 FEET; THENCE SOUTH 01 DEGREES 01 MINUTES EAST, A DISTANCE OF 17.0 FEET; THENCE NORTH 86 DEGREES 06 MINUTES 27 SECONDS EAST, A DISTANCE OF 21.86 FEET TO THE EAST LINE OF AFORESAID LOT 106; THENCE NORTH 12 DEGREES 16 MINUTES 40 SECONDS WEST, ALONG THE EAST LINE OF AFORESAID LOT 106 A DISTANCE OF 17.0 FEET TO THE POINT OF BEGINNING.
Any person claiming an interest in the surplus funds from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
