NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale dated the 11th day of July, 2013, and entered in Case No. 2009 CA 009172 NC, of the Circuit Court of the 12TH Judicial Circuit in and for Sarasota County, Florida, wherein THE BANK OF NEW YORK MELLON F/K/A THE BANK OF NEW YORK, AS TRUSTEE FOR THE HOLDERS OF THE CERTIFICATES, FIRST HORIZON MORTGAGE PASS-THROUGH CERTIFICATES SERIES FHAMS 2006-AA3, BY FIRST HORIZON HOME LOANS, A DIVISION OF FIRST TENNESSEE BANK NATIONAL ASSOCIATION, MASTER SERVICER, IN IT CAPACITY AS AGENT FOR THE TRUSTEE UNDER THE POOLING AND SERVIVING AGREEMENT is the Plaintiff and JOHN A. FERLAND; SUNTRUST BANK; JULIANNE FERLAND and UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.sarasota.realforeclose.com at, 9:00 AM on the 20th day of September, 2013, the following described property as set forth in said Final Judgment, to wit:
LOT 53, SUNSET BEACH SUBDIVISION, UNIT 1, A SUBDIVISION ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 7, PAGE(S) 62 AND 62A, INCLUSIVE, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
