THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF CWALT, INC., ALTERNATIVE LOAN TRUST 2005-IM1, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2005-IM1 is Plaintiff and RICHARD J. SPINELLI a/k/a RICHARD SPINELLI; KOLLEEN M. SPINELLI; ____SPINELLI, UNKNOWN SPOUSE OF RICHARD J. SPINELLI A/K/A RICHARD SPINELLI, IF MARRIED; JOHN DOE #1; JANE DOE #1; JOHN DOE #2; JANE DOE #2; JOHN DOE #3; JANE DOE #3; JOHN DOE #4; JANE DOE #4; are defendants. COMMENCE AT THE NORTHEAST CORNER OF LOT 8, MARLOWE PARK, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 4, PAGE 90, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, THENCE WEST ALONG NORTH LINE OF SAID LOT 8 158.55 FEET TO A POINT OF BEGINNING: THENCE CONTINUE WEST ALONG SAID NORTH LINE OF LOT 8 THENCE 103.78 FEET: THENCE SOUTH 100.7 FEET TO THE SOUTH LINE OF SAID LOT 8: THENCE SOUTH 89 DEGREES 46” EAST ALONG SAID SOUTH LINE OF LOT 8 103.78 FEET: THENCE NORTH 101.12 FEET TO THE POINT OF BEGINNING. BEING A PART OF 8, MARLOWE PARK, IN SECTION 12, TOWNSHIP 36 SOUTH, RANGE 17 EAST.
A person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
