NOTICE IS HEREBY GIVEN pursuant to a Summary Final Judgment of Foreclosure entered May 20, 2013 in Civil Case No. 2009-CA-010823-NC of the Circuit Court of the TWELFTH Judicial Circuit in and for Sarasota County, Sarasota, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE CERTIFICATE HOLDERS CWALT, INC., ALTERNATIVE LOAN TRUST 2006-OA21, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2006-OA21 AND/OR MERS AS APPROPRIATE is Plaintiff and THE UNKNOWN SPOUSE OF JOSEPH L. RUSSO N/K/A MRS. RUSSO, JOSEPH L RUSSO, CENTURY BANK, FSB, MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INCORPORATED AS NOMINEE FOR BAC HOME LOANS SERVICING, LP, TENANT #2 N/K/A CHARLIE BROWN, TENANT #1 N/K/A JAN EHART, are Defendants, the Clerk of Court will sell to the highest and best bidder for cash electronically at www.sarasota.realforeclose.com in accordance with Chapter 45, Florida Statutes on September 17, 2013 at 09:00 AM on the following described property as set forth in said Summary Final Judgment, to-wit:
A PARCEL OF LAND LYING IN SECTION 12, TOWNSHIP 37 SOUTH, RANGE 18 EAST, SARASOTA COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCE AT A FOUND IRON ROAD AT THE SOUTHWEST CORNER OF LOT 12, BLOCK D, FIRST ADDITION TO CEDAR GROVE, AS PER PLAT THEREOF RECORDED IN PLAT BOOK 1, PAGE 65 OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA, SAID POINT OF ALSO LIES 31.01` NORTH OF THE NORTH LINE OF COLONY MEADOWS SUBDIVISION AS RECORDED IN PLAT BOOK 39, PAGE 14 & 14A OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA; THENCE N 00° 00`32” E, ALONG THE EASTERLY LINE OF THE 30` WIDE RIGHT OF WAY FOR MOELLER AVENUE, A DISTANCE OF 77.29 FEET FOR A POINT OF BEGINNING; THENCE CONTINUE ALONG SAID RIGHT OF WAY LINE, N 00° 00` 32” E A DISTANCE OF 72.00 FEET; THENCE LEAVING SAID RIGHT OF WAY LINE S 89° 35` 36” E, A DISTANCE OF 118.96 FEET TO THE EASTERLY LINE OF LOT 10, BLOCK D OF SAID PLAT OF CEDAR GROVE; THENCE S 00° 02`54” E ALONG SAID EASTERLY LINE OF LOT 10 AND LOT 11, A DISTANCE OF 72.00 FEET; THENCE N 89° 35` 36” W A DISTANCE OF 119.03 FEET TO THE POINT OF BEGINNING.
