NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment dated September 18, 2013, entered in Civil Case No.: 52-2012-CA-011529, of the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, wherein THE BANK OF NEW YORK MELLON TRUST COMPANY, N.A. FKA THE BANK OF NEW YORK TRUST COMPANY, N.A. AS SUCCESSOR IN INTEREST TO JPMORGAN CHASE BANK, NATIONAL ASSOCIATION AS TRUSTEE FOR POOLING AND SERVICING AGREEMENT FOR RESIDENTIAL ASSET ACQUISITION CORPORATION, MORTGAGE LOAN ASSET-BACKED PASS-THROUGH CERTIFICATES, SERIES 2005-SP2, DATED AS OF SEPTEMBER 1, 2005, is Plaintiff, and VIVIAN H. FURIGAY-DUDGEON; DANA R. DUDGEON; CITY OF CLEARWATER, FLORIDA; UNKNOWN PERSON(S) IN POSSESSION OF THE SUBJECT PROPERTY; ALL OTHER UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER, AND AGAINST A NAMED DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAME UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS are Defendant(s).
KEN BURKE, the Clerk of Court shall sell to the highest bidder for cash at 10:00 a.m., online at www.pinellas.realforeclose.com, on the 18th day of December, 2013 the following described real property as set forth in said Final Summary Judgment, to wit:
LOT 1, BLOCK 4, ACKER'S SUBDIVISION, ACCORDING TO THE MAP OR PLAT THEREOF AS RECORDED IN PLAT BOOK 30, PAGE 91, OF THE PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
