NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment dated October 31, 2013, entered in Civil Case No.: 11002453CA, of the Circuit Court of the Twentieth Judicial Circuit in and for Charlotte County, Florida, wherein DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR IXIS REAL ESTATE CAPITAL TRUST 2007-HE-1 MORTGAGE PASS THROUGH CERTIFICATES, SERIES 2007-HE-1, is Plaintiff, and MICHAEL VOLK; UNKNOWN SPOUSE OF MICHAEL VOLK; MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR OCWEN LOAN SERVICING LLC; UNKNOWN TENANT #1; UNKNOWN TENANT #2; ALL OTHER UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER, AND AGAINST A NAMED DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAME UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS, are Defendant(s).
BARBARA T. SCOTT, the Clerk of Court shall sell to the highest bidder for cash at 11:00 a.m., in accordance with Chapter 45 Florida Statutes, online at www.charlotte.realforeclose.com on the 9 day of January, 2014 the following described real property as set forth in said Final Summary Judgment, to wit:
LOT 26, IN BLOCK 4435, OF PORT CHARLOTTE, SECTION EIGHTY TWO, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 6, AT PAGE 52A THROUGH 52M, OF THE PUBLIC RECORDS OF CHARLOTTE COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
