NOTICE IS HEREBY GIVEN pursuant to a Final Judgment filed December 4, 2013 entered in Civil Case No.: 36-2011-CA-055053 of the Circuit Court of the TWENTIETH Judicial Circuit in and for LEE COUNTY, Florida, wherein THE BANK OF NEW YORK MELLON TRUST CO, N.A, AS TRUSTEE FOR THE REGISTERED HOLDERS OF ACE SECURITIES CORP. HOME EQUITY LOAN TRUST, SERIES 2004-HS1, ASSET BACKED PASS-THROUGH CERTIFICATES, is Plaintiff, and ROBERT F. RICHLEN A/K/A ROBERT RICHLEN; CAROL ANN RICHLEN A/K/A CAROL RICHLEN; UNKNOWN SPOUSE OF DAVID A. LEWIS; UNKNOWN PERSON(s) IN POSSESSION OF THE SUBJECT PROPERTY; ALL OTHER UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER, AND AGAINST A NAMED DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAME UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS, are Defendants.
LINDA DOGGETT, the Clerk of Court shall sell to the highest bidder for cash online at www.lee.realforeclose.com at 9:00 a.m. on the 3day of January, 2014 the following described real property as set forth in said Final Judgment, to wit:
BEGINNING 340 FEET EAST AND 30 FEET SOUTH OF THE NORTHWEST CORNER OF THE NORTHWEST QUARTER OF SECTION 11, TOWNSHIP 44 SOUTH, RANGE 25 EAST, THENCE EAST 134.35 FEET; THENCE SOUTHWEST ALONG THE NORTH RIGHT-OF-WAY LINE OF RAILROAD 179.4 FEET TO A POINT 119 FEET SOUTH OF THE POINT OF BEGINNING; THENCE NORTH 119 FEET TO THE POINT OF BEGINNING, SAID LANDS LYING AND BEING IN LEE COUNTY, FLORIDA.

If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
