NOTICE IS HEREBY GIVEN pursuant to a Summary Final Judgment of Foreclosure filed DEC 05 2013, entered in Case No. 12-CA-056465 of the Circuit Court of the Twentieth Judicial Circuit, in and for Lee County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF CWABS INC., ASSET-BACKED CERTIFICATES, SERIES 2007-12 is the Plaintiff and MAELEE B. MADRIGAL; UNKNOWN SPOUSE OF MAELEE B. MADRIGAL; COTTAGE POINT RECREATIONAL ASSOCIATION, INC.; UNKNOWN TENANT(S) IN POSSESSION #1 AND #2; AND ALL OTHER UNKNOWN PARTIES, INCLUDING, IF A NAMED DEFENDANT IS DECEASED, THE PERSONAL REPRESENTATIVES, THE SURVIVING SPOUSE, HEIRS, DEVISEES, GRANTEES, CREDITORS, AN ALL OTHER PARTIES CLAIMING BY, THROUGH, UNDER OR AGAINST THAT DEFENDANT, AND ALL CLAIMANTS, PERSONS OR PARTIES, NATURAL OR CORPORATE, OR WHOSE EXACT LEGAL STATUS IS UNKNOWN, CLAIMING UNDER ANY OF THE ABOVE NAMED OR DESCRIBED DEFENDANTS are the Defendants, that I will sell to the highest and best bidder for cash by electronic sale at www.lee.realforeclose.com, beginning at 9:00 AM on the 6 day of January, 2014, the following described property as set forth in said Final Judgment, to wit:
LOT 3, BLOCK D, COTTAGE POINT SUBDIVISION, ACCORDING TO THE MAP ATTACHED TO DEED RECORDED IN DEED BOOK 259, PAGE 222, PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within sixty (60) days after the sale.
