NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure filed the 4 day of December, 2013, and entered in Case No. 11-CA-053939, of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein U.S. BANK, NATIONAL ASSOCIATION, AS SUCCESSOR TRUSTEE TO BANK OF AMERICA, N.A. AS SUCCESSOR BY MERGER TO LASALLE BANK, N.A., AS TRUSTEE FOR THE HOLDERS OF THE MERRILL LYNCH FIRST FRANKLIN MORTGAGE LOAN TRUST, MORTGAGE LOAN ASSET-BACKED CERTIFICATES, SERIES 2007-FF2, is the Plaintiff and NORMAN C. PIGEON, SUNTRUST BANK, and UNKNOWN TENANT IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.Lee.realforeclose.com at, 9:00 AM on the 3 day of April, 2014, the following described property as set forth in said Final Judgment, to wit:
LOT 13, EXCEPTING THEREFROM THAT CERTAIN PORTION OF SAID LOT 13 DESCRIBED AS FOLLOWS; BEGINNING ON THE WESTERLY LINE OF SAID LOT 13, THENCE NORTHERLY 4 FEET TO THE NORTHWEST CORNER OF SAID LOT 13; THENCE EASTERLY ON THE LINE DIVIDING LOT 1 AND LOT 13, A DISTANCE OF 50 FEET; THENCE SOUTHWESTERLY TO THE POINT OF BEGINNING OF THE LAND HEREIN EXCEPTED, ALL BEING IN THAT CERTAIN SUBDIVISION KNOWN AS CUTRIGHT'S SUBDIVISION, AS PER PLAT RECORDED IN PLAT BOOK 6, PAGE 43, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
ALSO THAT PORTION OF LOT 1 OF THAT CERTAIN SUBDIVISION KNOWN AS CUTRIGHT'S SUBDIVISION AS PER PLAT RECORDED IN PLAT BOOK 6, PAGE 43, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA, DESCRIBED AS FOLLOWS; BEGINNING AT A POINT ON THE EASTERLY LINE OF SAID LOT 1, 4 FEET NORTHERLY FROM THE SOUTHEAST CORNER OF SAID LOT 1, THENCE SOUTHERLY ALONG THE EASTERLY LINE OF SAID LOT 1 TO THE SOUTHEAST CORNER OF SAID LOT 1; THENCE WESTERLY ON THE LINE DIVIDING LOT 13 AND LOT 1, A DISTANCE OF 50 FEET; THENCE NORTHEASTERLY TO THE POINT OF BEGINNING.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
