NOTICE IS HEREBY GIVEN that sale will be made pursuant to an Order or Final Summary Judgment. Final Judgment was awarded on December 5, 2013 in Civil Case No. 11-CA-050045, of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein, BRANCH BANKING AND TRUST COMPANY (BB&T) is the Plaintiff, and, JOE CUNNINGHAM; CYNTHIA CUNNINGHAM; PARK HOMES AT TARPON GARDENS CONDOMINIUM ASSOCIATION, INC.; TARPON POINT ASSOCIATES, LLC; TARPON POINT PROPERTY OWNERS' ASSOCIATION, INC.; ROSEMARY MAZZOLA; SUZANNE CARMEL, are Defendants.
The clerk of the court will sell to the highest bidder for cash online at www.lee.realforeclose.com at 9:00 a.m. on the 4 day of April, 2014, the following described real property as set forth in said Final summary Judgment, to wit:
CONDOMINIUM UNIT NO. 202, BUILDING NO. 2, PARK HOMES AT TARPON GARDENS, PHASE 1, A CONDOMINIUM, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, RECORDED IN OFFICIAL RECORDS BOOK 4154, PAGE 3726, AS AMENDED FROM TIME TO TIME, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
