NOTICE IS HEREBY GIVEN Pursuant to an Order Rescheduling Foreclosure Sale filed February 7, 2013, and entered in Case No. 09-CA-065916 of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida in which The Bank Of New York Mellon FKA The Bank of New York As Trustee For The Certificateholders Of BVMBS 2004-2, is the Plaintiff and Keri Caruthers, Unknown Spouse of Keri Caruthers N/K/A Jan Caruthers, are defendants, I will sell to the highest and best bidder for cash at www.lee.realforeclose.com in accordance with chapter 45 Florida Statutes , Lee County, Florida at 9:00am on the 8 day of April, 2013, the following described property as set forth in said Final Judgment of Foreclosure:
LOTS 24, 25 AND 26, BLOCK 872, UNIT 26, CAPE CORAL SUBDIVISION, ACCORDING TO THE MAP OR PLAT THEREOF AS RECORDED IN PLAT BOOK 14, PAGES 117 THROUGH 148, PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
