NOTICE IS HEREBY given pursuant to Final January 24, 2013, and entered in Case No. 522011CA006507 of the Circuit Court of the 6th Judicial Circuit in and for Pinellas County, Florida, wherein CAPITAL ONE, N.A., SUCCESSOR BY MERGER TO ING BANK, FSB, is the Plaintiff and Frank J. Colucci, IV, A/K/A Frank Colucci IV; Christina Elizabeth Marchiano, A/K/A Christina E. Marchiano F/K/A Christina E. Colucci; Unknown Spouse of Christina Elizabeth Marchiano A/K/A Christina E. Marchiano F/K/A Christina E. Colucci, if any; PNC Bank, N.A., Successor by Merger to National City Bank; 51 Island Way Condominium Association, Inc.; and Unknown Tenant(s), are the Defendants, the Clerk of Court will sell to the highest and best bidder for cash by electronic sale at www.pinellas.realforeclose.com beginning at 10:00 a.m. Eastern Time, on March 5, 2013, the following described property set forth in said Order or Final Judgment, to wit:
That certain Condominium Parcel described as Unit 200, 51 Island Way Condominium, and an undivided interest or share in the common elements appurtenant thereto, in accordance with and subject to the covenants, conditions, restrictions, easements, terms and other provisions of the Declaration of Condominium of 51 Island Way Condominium, as recorded in Official Records Book 4750, page 318, and amendments thereto, and the Plat thereof recorded, in Condominium Plat Book 30, page 38-54, Public Records of Pinellas County, Florida.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK OF COURT NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
