NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure dated February 12, 2013, and entered in Case No. 52-2010-CA-006693, of the Circuit Court of the Sixth Judicial Circuit in and for PINELLAS County, Florida. BANK OF AMERICA, N.A., SUCCESSOR BY MERGER TO BAC HOME LOANS SERVICING, LP FKA COUNTRYWIDE HOME LOANS SERVICING LP, is Plaintiff and UNKNOWN SPOUSE, HEIRS, DEVISEES, GRANTEES, ASSIGNEES, LIENOR, CREDITORS, TRUSTEES AND ALL OTHER PARTIES CLAIMING AN INTEREST BY, THROUGH, UNDER OR AGAINST THE ESTATE OF HARRIET C. SMITH, DECEASED; MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR FIRST MAGNUS FINANCIAL CORPORATION, AN ARIZONA CORPORATION; OAKHURST GARDEN APARTMENTS CONDOMINIUM ASSOCIATION, INC.; DEBRA BRAND; HARRY SMITH A/K/A HARRY VADEN SMITH; KAREN TOWNSON; JAMES WILLIAM GORHAM; WAYNE SMITH; are defendants. The Clerk of Court will sell to the highest and best bidder for cash via the Internet at www.pinellas.realforeclose.com, at 10:00 a.m., on the 1st day of April, 2013, the following described property as set forth in said Final Judgment, to wit:
CONDOMINIUM PARCEL: UNIT NO. 207, OF OAKHURST GARDEN APARTMENTS, A CONDOMINIUM, ACCORDING TO THE PLAT THEREOF RECORDED IN CONDOMINIUM PLAT BOOK 53, PAGE 31, AND BEING FURTHER DESCRIBED IN THAT CERTAIN DECLARATION OF CONDOMINIUM RECORDED IN O.R. BOOK 5227, PAGE 1542 ET SEQ., TOGETHER WITH SUCH ADDITIONS AND AMENDMENTS TO SAID DECLARATION AND CONDOMINIUM PLAT AS FROM TIME TO TIME MAY BE MADE AND TOGETHER WITH AN UNDIVIDED INTEREST OR SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO. ALL AS RECORDED IN THE PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
