NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure filed the 27 day of December, 2012, and entered in Case No. 36-2009-CA-069129, of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein U.S. BANK NATIONAL ASSOCIATION, AS INDENTURE TRUSTEE OF THE HOMEBANC MORTGAGE TRUST 2005-3 is the Plaintiff and ALFRED GOETZFRIED, CITIBANK (SOUTH DAKOTA), N.A., KELLY ROOFING INC, A DISSOLVED CORPORATION, PELICAN LANDING COMMUNITY ASSOCIATION, INC., PELICAN'S NEST GOLF CLUB, INC., R.L. JAMES,CO INC., A DISSOLVED CORPORATION, THE TIDES AT PELICAN LANDING CONDOMINIUM ASSOCIATION, INC., WACHOVIA BANK, NATIONAL ASSOCIATION, FORMERLY KNOWN AS FIRST UNION NATIONAL BANK, UNKNOWN SPOUSE OF ALFRED GOETZFRIED and UNKNOWN TENANT(S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.Lee.realforeclose.com at, 9:00 AM on the 26 day of April, 2013, the following described property as set forth in said Final Judgment, to wit:
CONDOMINIUM UNIT 10110, BUILDING 10, THE TIDES AT PELICAN LANDING CONDOMINIUM, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF RECORDED IN BOOK 4640, PAGE 620, ET SEQ., TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO, AS AMENDED FROM TIME TO TIME, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
