NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure dated April 09, 2012and an Order Rescheduling Foreclosure Sale dated December 07, 2012, entered in Civil Case No.: 10-CA-004300 (D) of the Circuit Court of the Thirteenth Judicial Circuit in and for Hillsborough County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS TRUSTEE FOR THE CERTIFICATE HOLDERS CWABS, INC. ASSET-BACKED CERTIFICATES, SERIES 2005-6, Plaintiff, and NICHOLAS CHRISTOPHER OCTAVIANO, UNKNOWN SPOUSE OF NICHOLAS CHRISTOPHER OCTAVIANO, ALL OTHER UNKNOWN PARTIES, INCLUDING, IF A NAMED DEFENDANT IS DECEASED, THE PERSONAL REPRESENTATIVES, THE SURVIVING SPOUSE, HEIRS, DEVISEES, GRANTEES, CREDITORS, AND ALL OTHER PARTIES CLAIMING, BY, THROUGH, UNDER OR AGAINST THAT DEFENDANT, AND ALL CLAIMANTS, PERSONS OR PARTIES, NATURAL OR CORPORATE, OR WHOSE EXACT LEGAL STATUS IS UNKNOWN, CLAIMING UNDER ANY OF THE ABOVE NAMED OR DESCRIBED DEFENDANTS, MORTGAGE ELECTRONIC REGISTRATION SYSTEMS INC. PAT FRANK, The Clerk of the Circuit Court, will sell to the highest bidder for cash, www.hillsborough.realforeclose.com, at 10:00 AM, on the 28th day of January, 2013, the following described real property as set forth in said Final Summary Judgment, to wit:
THE NORTH 1/2 OF THE SOUTH 1/2 OF THE NW 1/4 OF THE NW 1/4 OF THE SE 1/4 OF SECTION 5, TOWNSHIP 30 SOUTH, RANGE 21 EAST, HILLSBOROUGH COUNTY, FLORIDA, LESS THE EAST 15 FEET AND LESS THE WEST 25 FEET FOR ROAD.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
