NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure filed the 28 day of September, 2012, and entered in Case No. 11-CA-54664, of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein THE BANK OF NEW YORK MELLON, FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF CWMBS, INC., ALTERNATIVE LOAN TRUST 2002-7 MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2002-11 is the Plaintiff and JULIAN PRIETO A/K/A JULIAN PRIETO MR, BANK OF AMERICA, N.A. C/O CT CORPORATION SYSTEM, DEER LAKE MASTER PROPERTY OWNERS ASSOCIATION, INC. C/O SCHOO MANAGEMENT, INC., A REGISTERED AGENT, DEER LAKE HOMEOWNERS ASSOCIATION, INC., JENNIFER L. PRIETO A/K/A JENNIFER PRIETO, AKA JENNIFER LYNN PRIETO, UNKNOWN TENANT(S) and UNKNOWN SPOUSE OF JULIAN PRIETO IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.Lee.realforeclose.com at, 9:00 AM on the 31 day of January, 2013, the following described property as set forth in said Final Judgment, to wit:
LOT 18, DEER LAKE, UNIT 1, ACCORDING TO THE PLAT THEREOF, RECORDED IN PLAT BOOK 58, PAGE 73, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
