NOTICE IS HEREBY given pursuant to an Order or Final Judgment of Foreclosure filed January 3, 2013, and entered in Case No. 09-CA-054677 of the Circuit Court of the 20th Judicial Circuit in and for Lee County, Florida, wherein Nationstar Mortgage, LLC, is the Plaintiff and Phyllis E. Howard; Amy L. Blackmore; Harmony Pointe Emerson Square Community Association, Inc.; Mers, Inc.; and Current Tenant(s), are the Defendants, the Clerk of Court will sell to the highest and best bidder for cash by electronic sale at www.lee.realforeclose.com beginning at 9:00 a.m. Eastern Time, on February 4, 2013, the following described property set forth in said Order or Final Judgment, to wit:
UNIT K-202, HAROMONY POINTE AT EMERSON SQUARE, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED AS INSTRUMENT NUMBER 2006000080338, AND ANY AMENDMENTS AND/OR SUPPLEMENTAL DECLARATIONS THERETO, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO.
if you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk of court no later than 60 days after the sale. if you fail to file a claim, you will not be entitled to any remaining funds. after 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
