NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure dated August 22, 2012 and an Order Granting Third Party Purchaser's Objection to Sale, Rescheduling Foreclosure Sale and Directing Clerk to Dispurse Forfeited Funds dated December 20, 2012, entered in Civil Case No.: 08-CA-003490 (J) of the Circuit Court of the Thirteenth Judicial Circuit in and for Hillsborough County, Florida, wherein BANK OF AMERICA, N.A., SUCCESSOR BY MERGER TO BAC HOME LOANS SERVICING, LP FKA COUNTRYWIDE HOME LOANS SERVICING, LP, Plaintiff, and MARK A. BATCHELOR AND ___ BATCHELOR, UNKNOWN SPOUSE OF MARK A. BATCHELOR, IF MARRIED; CORINA F. BATCHELOR AND ___ BATCHELOR, UNKNOWN SPOUSE OF CORINA F. BATCHELOR, IF MARRIED N/K/A JUSTIN MICHAEL ORTEL; ALL OTHER UNKNOWN PARTIES, INCLUDING, IF A NAMED DEFENDANT IS DECEASED, THE PERSONAL REPRESENTATIVES, THE SURVIVING SPOUSE, HEIRS, DEVISEES, GRANTEES, CREDITORS, AND ALL OTHER PARTIES CLAIMING, BY, THROUGH, UNDER OR AGAINST THAT DEFENDANT, AND ALL CLAIMANTS, PERSONS OR PARTIES, NATURAL OR CORPORATE, OR WHOSE EXACT LEGAL STATUS IS UNKNOWN, CLAIMING UNDER ANY OF THE ABOVE NAMED OR DESCRIBED DEFENDANTS; HILLSBOROUGH COUNTY; are Defendants.
PAT FRANK, The Clerk of the Circuit Court, will sell to the highest bidder for cash, www.hillsborough.realforeclose.com, at 10:00 AM, on the 4th day of February, 2013, the following described real property as set forth in said Final Summary Judgment, to wit:
LOTS 79 AND 80 OF NORTH END TERRACE, ACCORDING TO THE MAP OR PLAT THEREOF AS RECORDED IN PLAT BOOK 14, PAGE 32, OF THE PUBLIC RECORDS OF HILLSBOROUGH COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
