T of the Circuit Court of the 20th Judicial Circuit in and for Lee County, Florida, NATIONAL CITY BANK SUCCESSOR BY MERGER TO NATIONAL CITY MORTGAGE CO. is the Plaintiff and Sarah D. Penna; John T. Penna; Enclave Property Owners Association, Inc.; Beacon Building Corporation; Bank of America, N.A.; and Enclave Subdivision Property Owners Association, Inc., are the Defendants, the Clerk of Court will sell to the highest and best bidder for cash by electronic sale at www.lee.realforeclose.com beginning at 9:00 a.m. Eastern Time, on February 11, 2013, the following described property set forth in said Order or Final Judgment, to wit:
LOIT 2, ENCLAVE, (BEING A REPLAT OF BLOCK 4640 OF UNIT NO. 69, CAPE CORAL SUBDIVISION RECORDED IN PLAT BOOK 22 PAGE 46 AS PER PLAT THEREOF RECORDED IN PLAT BOOK 71 PAGES 85 AND 86, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
if you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk of court no later than 60 days after the sale. if you fail to file a claim, you will not be entitled to any remaining funds. after 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
