NOTICE IS HEREBY GIVEN pursuant to an Order Rescheduling Foreclosure Sale filed January 9, 2013, and entered in Case No. 09 Ca 069455, of the Circuit Court of the Twentieth Judicial Circuit in and for LEE County, Florida. THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK,AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF THE CWABS, INC., ASSET-BACKED CERTIFICATES, SERIES 2006-10 is Plaintiff and DANIEL L. RADEN A/K/A DANIEL LEON RADEN; , et al; are defendants. The Clerk of Court will sell to the highest and best bidder for cash at www.lee.realforeclose.com at 9:00 a.m. on the 10 day of April, 2013, the following described property as set forth in the Final Judgment filed April 16, 2010, to wit:
THE FOLLOWING DESCRIBED LAND LOCATED IN THE COUNTY OF LEE, STATE OF FLORIDA, TO-WIT: BEGIN 140 FEET WEST OF THE SOUTHEAST CORNER OF LOT 77, IN THAT CERTAIN SUBDIVISION KNOWN AS ARROYAL, ACCORDING TO THE PLAT THEREOF IN PLAT BOOK 3, PAGE 80, PUBLIC RECORDS OF LEE COUNTY, FLORIDA; THENCE NORTH 140 FEET; THENCE WEST 120 FEET; THENCE SOUTH 140 FEET; THENCE EAST 120 FEET TO THE POINT OF BEGINNING (KNOWN AS LOT 5 AND THE WEST 40 FEET OF LOT 3 OF AN UNRECORDED PLAT OB BONITA PINES SUBDIVISION.
ANY person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim with 60 days after the foreclosure sale.
