NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale dated the 14th day of January, 2013, and entered in Case No. 48-2009-CA-022808-O, of the Circuit Court of the 9TH Judicial Circuit in and for Orange County, Florida, wherein FEDERAL NATIONAL MORTGAGE ASSOCIATION is the Plaintiff and ASHLEY NICOLE FOGARTY A/K/A ASHLEY FOGARTY, SOUTHPOINTE CONDOMINIUM ASSOCIATION, INC., UNKNOWN TENANT(S) and UNKNOWN SPOUSE OF ASHLEY NICOLE FOGARTY A/K/A NICOLE FOGARTY IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The foreclosure sale is hereby scheduled to take place on-line on the 28th day of February, 2013 at 11:00 AM at www.myorangeclerk.realforeclose.com. The Orange County Clerk of Court shall sell the property described to the highest bidder for cash after giving notice as required by section 45.031, Florida statutes, as set forth in said Final Judgment, to wit:
CONDOMINIUM UNIT U1 (THE UNIT) IN BUILDING 14, IN SOUTHPOINTE UNIT V, A CONDOMINIUM ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF AS RECORDED IN OR BOOK 3867 PAGE 2850 TOGETHER WITH A SURVEY AND PLOT PLAN RECORDED IN CONDOMINIUM BOOK 14, PAGES 97 AND 98 ALL IN THE PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA AND FURTHER AMENDMENTS IF ANY TO SAID DECLARATION (SAID DECLARATION AND AMENDMENTS THERETO HEREINAFTER COLLECTIVELY REFERRED TO AS THE DECLARATION) TOGETHER WITH ALL APPURTENANCES THERETO INCLUDING AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPERTAINING TO THE UNIT AS MORE PARTICULARLY SET FORTH IN THE DECLARATION.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
