NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 24th day of June, 2013, and entered in Case No. 29-2012-CA-014096, of the Circuit Court of the 13TH Judicial Circuit in and for Hillsborough County, Florida, wherein HSBC BANK USA, NATIONAL ASSOCIATION, AS TRUSTEE FOR NAAC 2007-2 is the Plaintiff and WILLIAM V. SIMMS JR; BAY POINTE WATERFRONT CONDOMINIUM ASSOCIATION, INC.; DEPARTMENT OF THE TREASURY-INTERNAL REVENUE SERVICE and UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.hillsborough.realforeclose.com, the Clerk's website for on-line auctions at, 10:00 AM on the 12th day of August, 2013, the following described property as set forth in said Final Judgment, to wit:
CONDOMINIUM UNIT NO. B-104, BAY POINTE CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM FILED ON THE 17TH DAY OF MARCH 1976, IN O.R. BOOK 3101 PAGE 1382 OF THE PUBLIC RECORDS OF HILLSBOROUGH COUNTY, FLORIDA, AND ACCORDING TO THE CONDOMINIUM PLAT RECORDED IN CONDOMINIUM PLAT BOOK 1, PAGE 84 OF THE PUBLIC RECORDS OF HILLSBOROUGH COUNTY, FLORIDA, TOGETHER WITH AN UNDIVIDED SHARE IN COMMON ELEMENTS APPURTENANT THEREOF. A PERPETUAL AND NON-EXCLUSIVE EASEMENT IN COMMON WITH, BUT NOT LIMITED TO, ALL OTHER OWNERS, OF UNDIVIDED INTEREST IN THE IMPROVEMENTS UPON THE LAND ABOVE DESCRIBED FOR INGRESS AND EGRESS AND USE OF PUBLIC PASSAGE WAYS AS WELL AS COMMON AREAS AND FACILITIES UPON THE LAND ABOVE DESCRIBED
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
