NOTICE IS HEREBY GIVEN pursuant to an Order or Summary Final Judgment of foreclosure dated April 30, 2013, and entered in Case No. 12-002650-CI-11 UCN: 522012CA002650XXCICI of the Circuit Court in and for Pinellas County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK,AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF THE CWABS, INC., ASSET-BACKED CERTIFICATES, SERIES 2006-23 is Plaintiff and RICHARD F. GERG; WELLS FARGO BANK, N.A.; WHISPER WOOD TOWNHOMES CONDOMINIUM ASSOCIATION, INC.; MARIE GERG; UNKNOWN TENANT NO. 1; UNKNOWN TENANT NO. 2; and ALL UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER OR AGAINST A NAMED DEFENDANT TO THIS ACTION, OR HAVING OR CLAIMING TO HAVE ANY RIGHT, TITLE OR INTEREST IN THE PROPERTY HEREIN DESCRIBED, are Defendants, KEN BURKE, Clerk of the Circuit Court, will sell to the highest and best bidder for cash online at www.pinellas.realforeclose.com County, Florida, 10:00 a.m. on the 1st day of August 2013, the following described property as set forth in said Order or Final Judgment, to-wit:
THAT CERTAIN CONDOMINIUM PARCEL CONSISTING OF UNIT 4, BUILDING 1, TOGETHER WITH AN UNDIVIDED SHARE IN THE COMMON ELEMENT APPURTENANT THERETO, IN ACCORDANCE WITH AND SUBJECT TO THE TERMS, CONDITIONS, COVENANTS, EASEMENTS, RESTRICTIONS, AND OTHER PROVISIONS OF THE CERTAIN DECLARATION OF CONDOMINIUM OF WHISPER WOOD TOWNHOMES, A CONDOMINIUM RECORDED IN O. R. BOOK 4962, PAGES 1581, AND ANY AMENDMENTS THERETO, AND ACCORDING TO THE PLAT THEREOF, AS RECORDED IN CONDOMINIUM PLAT BOOK 39, PAGES 1 THROUGH 7, AND ANY AMENDMENTS THERETO, PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
