NOTICE IS HEREBY GIVEN that Sale will be made pursuant to an Order or Final Judgment. Final Judgment was awarded on July 18, 2013, in Civil Case No. 11-2010-CA-005885, of the Circuit Court of the 20th Judicial Circuit in and for COLLIER County, Florida, wherein, NATIONSTAR MORTGAGE, LLC is the Plaintiff, and EDWARD RYBACZUK; ANDREW MALARZ; BOCA CIEGA VILLAGE CONDOMINIUM I ASSOCIATION INC.; BANK OF AMERICA, N.A.; UNKNOWN SPOUSE OF EDWARD RYBACZUK; UNKNWN SPOUSE OF ANDREW MALARZ; JOHN DOE N/K/A ARNOLD MALARZ; AND UNKNOWN TENANT(S) IN POSSESSION are Defendants.
The clerk of the court will sell to the highest bidder for cash at 11:00 AM in the lobby on the 3rd floor of the Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples FL 34112 on this 14 day of August, 2013, the following described real property as set forth in said Final Summary Judgment, to wit:
UNIT 1044, BOCA CIEGA VILLAGE CONDOMINIUM I, PHASE IV, A CONDOMINIUM, ACCORDING TO THE DECLARATION THEREOF AS RECORDED IN OFFICIAL RECORDS BOOK 909, PAGES 739 THROUGH 808, INCLUSIVE, AND SUBSEQUENT AMENDMENTS THERETO, OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA.

ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
