Defendants.
NOTICE is hereby given pursuant to the Final Judgment entered in the above noted case that the Sarasota County Clerk of Court will sell the following property in Sarasota County, Florida and Manatee County, Florida, described as:
Units C-1, C-4 and E-4, CANTERBURY COMMONS NORTH, a condominium, according to the Declaration of Condominium thereof, as recorded in Official Records Book 2135, Page 5529, as thereafter amended, and as per Plat thereof recorded in Condominium Book 35, Page 128, as thereafter amended, of the Public Records of Manatee County, Florida.
AND
Units 2740-A and 2717-D, HIDDEN LAKE VILLAGE, a condominium, according to the Declaration of Condominium thereof, as recorded in Official Records Book 1368, Page 1482, as thereafter amended, and as per Plat thereof recorded in Condominium Book 14, Page 16, as thereafter amended, of the Public Records of Sarasota County, Florida.
(collectively “Property”)
TOGETHER WITH:
1. All the improvements now or hereafter erected on the Property and all fixtures now or hereafter attached thereto, together with each and every tenements, hereditaments, easements, rights, powers, privileges, immunities and appurtenances thereunto belonging or in anywise appertaining and the reversion and reversions, remainder and remainders, and also all the estate, right, title, interest, homestead, right of dower, separate estate, property, possession and claim whatsoever in law as well as in equity of the defendants, in and to the same in every part and parcel thereof.
2. All personal property and fixtures affixed to or located on the Property.
3. All rents, leases, issues, profits, revenue, income, proceeds and other benefits from the Property
4. All insurance policies and proceeds thereof and all condemnation proceeds, awards, damages, and claims relating to or derived from the Property.
At public sale, to the highest and best bidder for cash, via the internet at www.sarasota.realforeclose.com, at 9:00 a.m. on the 16th day of August, 2013. The highest bidder shall immediately post with said clerk, a deposit equal to 5% of the final bid. The deposit must be cash or cashier's check payable to the Clerk of the Circuit Court. Final payment must be made on or before 4:00 p.m. of the date of sale by cash or cashier's check.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
