NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 15th day of April, 2013, and entered in Case No. 58-2008-CA-007954-NC, of the Circuit Court of the 12TH Judicial Circuit in and for Sarasota County, Florida, wherein U.S. BANK NATIONAL ASSOCIATION AS SUCCESSOR CORPORATE TRUSTEE TO WACHOVIA BANK, N.A. AS AFOESAID AND NOT INDIVIDUALLY FOR CHASE MANHATTAN MORTGAGE 2003-4 is the Plaintiff GEORGE KENNEY A/K/A GEORGE THOMAS KENNEY; CAPITAL ONE BANK; NATIONAL CITY BANK; UNKNOWN SPOUSE OF GEORGE KENNEY A/K/A GEORGE THOMAS KENNEY; UNKNOWN SPOUSE OF VIRGINIA BAER SMITH A/K/A VIRIGINIA B. SMITH; VIRGINIA BAER SMITH A/K/A VIRGINIA B. SMITH; JOHN DOE; JANE DOE AS UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.sarasota.realforeclose.com at, 9:00 AM on the 13th day of August, 2013, the following described property as set forth in said Final Judgment, to wit:
THE EAST 1/2 OF LOT 238, LESS THE NORTHERLY 10 FEET THEREOF, ALL OF LOT 239, LESS THE NORTHERLY 10 FEET OF THE WEST 1/2, AND THE WEST 1/2 OF LOT 240, BAY ISLAND SUBDIVISION, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 2, AT PAGE 171, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
