NOTICE OF PRESERVATION OF DECLARATION
OF PROTECTIVE COVENANTS, CONDITIONS AND
RESTRICTIONS FOR PALMER RANCH
UNDER MARKETABLE RECORD TITLE ACT
AS MADE AND FILED BY

ASSOCIATION, INC.
In accordance with Chapter 712, Florida Statutes, the undersigned, PALMER RANCH MASTER PROPERTY OWNERS ASSOCIATION, INC., a Florida non-profit corporation (hereinafter “Association”), hereby makes and files this Notice of Preservation of Declaration of Protective Covenants, Conditions and Restrictions for Palmer Ranch (hereinafter “Notice”), for the purpose of preserving certain covenants, conditions and restrictions. The preservation of the existing Covenants, Conditions and Restrictions was approved by not less than two-thirds (2/3) of the entire membership of the Board of Trustees at a Board meeting properly held on June 18, 2013 after not less than seven (7) days' notice by mail to the membership of the Association and provision of the statement of marketable title action described in s.712.06(1)(b), Florida Statutes. In support of this Notice, the Association declares as follows:

1. The name and address of the Association is PALMER RANCH MASTER PROPERTY OWNERS ASSOCIATION, INC., a Florida non-profit corporation, 6142 Clark Center Avenue, Sarasota, Florida 34238.

2. Attached hereto as Exhibit “A” is an Affidavit executed by the authorized Secretary of the Association, being a member of the Board of Trustees, affirming that the Board of Trustees of the Association caused the Statement of Marketable Title Action as signed by the authorized President and Secretary of the Association and attached thereto as Exhibit “1”, to be mailed or hand-delivered to the parcel owners/members of the Association.

3. The lands affected by this Notice are those properties identified in the following Resolutions and Ordinances adopted by the Sarasota County Board of County Commissioners, approving Incremental Development Orders for the Increments of the Palmer Ranch Development of Regional Impact. Copies of the legal descriptions contained in the Incremental Development Orders are attached hereto and incorporated herein. Pursuant to Article 3.01 of the Declaration, the County's resolution adopting an Incremental Development Order shall have the effect of adding the real property subject to the IDO to the Committed Property, as defined in the Declaration.

4. The real property interest claimed under this Notice is the right to preserve and to continue to administer and enforce those certain use restrictions, covenants, easements, conditions and agreements set forth in the following documents:
The Declaration of Protective Covenants, Conditions and Restrictions for Palmer Ranch, dated and recorded October 22, 1986, in Official Records Book 1894 at Page 2467; First Amendment thereto dated July 25, 1988 and recorded August 3, 1988 in Official Records Book 2052 at Page 200 and re-recorded on September 14, 1988 in Official Records Book 2062, at Page 169; Second Amendment thereto dated July 25, 1988 and recorded August 3, 1988 in Official Records Book 2052 at Page 204 and re-recorded on September 14, 1988 in Official Records Book 2062 at Page 173; Third Amendment thereto dated December 20, 1995 and recorded January 12, 1996 in Official Records Book 2811 at Page 968; Fourth Amendment thereto dated November 14, 1997 and recorded November 21, 1997 in Official Records Book 3037 at Page 2698; Fifth Amendment thereto dated January 13, 1999 and recorded January 20, 1999 as Instrument #1999008464; Sixth Amendment thereto dated March 15, 1999 and recorded March 17, 1999 as Instrument #1999036584; Seventh Amendment thereto dated November 13, 2001 and recorded November 19, 2001 as Instrument #2001167293; and Eighth Amendment thereto dated April 21, 2003 and recorded April 22, 2003 as Instrument #2003076970, all of the Public Records of Sarasota County, Florida, and as the same may have been further amended from time to time (hereinafter “Restrictions”), currently burden the property of each and every member of the Association/parcel owner of the subdivision(s).

BEFORE ME, the undersigned authority, this day personally appeared TRACY SMITH, who, being personally known to me and upon first being duly sworn, deposes and says as follows:
1. Affiant is the duly elected Secretary and a member of the Board of Trustees of PALMER RANCH MASTER PROPERTY OWNERS ASSOCIATION, INC., a Florida non-profit corporation organized under Florida Statutes, Chapters 617 and 720 (hereinafter “Association”).

2. That the attached Statement of Marketable Title Action, identified as Exhibit “1” hereto, was approved at a meeting of the Board of Trustees of the Association for preservation of use restrictions under Marketable Record Title Act held on June 18, 2013, at 3:00 P.M., at 8490 McIntosh Road, Sarasota, Florida 34238, and it has been mailed or hand-delivered to every parcel owner/member of the Association as required by Section 712.06, Florida Statutes.

3. That the aforesaid Statement of Marketable Title Action was mailed to the parcel owners/members, addressed and sent to the property addresses or to the last known mailing addresses of the parcel owners/members as they appear on the books and records of the Association, as applicable.
