VALIDATION OF THE CITY OF MADEIRA BEACH, FLORIDA CAPITAL IMPROVEMENT
REVENUE BONDS, SERIES 2013 IN A PRINCIPAL AMOUNT NOT TO EXCEED $6,500,000
TO: THE STATE OF FLORIDA, THROUGH THE STATE ATTORNEY FOR THE SIXTH JUDICIAL CIRCUIT OF THE STATE OF FLORIDA, AND TO THE SEVERAL TAXPAYERS, PROPERTY OWNERS, AND CITIZENS OF THE CITY OF MADEIRA BEACH, FLORIDA, INCLUDING NON-RESIDENTS OWNING PROPERTY OR SUBJECT TO TAXATION THEREIN, AND ALL OTHERS HAVING OR CLAIMING ANY RIGHT, TITLE OR INTEREST IN PROPERTY TO BE AFFECTED BY THE ISSUANCE OF THE CITY OF MADEIRA BEACH, FLORIDA CAPITAL IMPROVEMENT REVENUE BONDS, SERIES 2013 IN A PRINCIPAL AMOUNT NOT TO EXCEED $6,500,000 OR TO BE AFFECTED IN ANY WAY THEREBY;
The above cause coming on to be heard upon the Complaint for Validation (the “Complaint”) this day filed herein by the City of Madeira Beach, Florida, seeking to determine the authority of the City of Madeira Beach, Florida, to issue its Capital Improvement Revenue Bonds, Series 2013, in a principal amount not to exceed $6,500,000 (the “Bonds”), a more particular description of such obligations being contained in the Complaint filed in these proceedings, to determine the legality of the proceedings had and taken in connection therewith, and the legality of the provisions, projects, covenants and agreements contained therein and the revenues and funds pledged to the payment thereof, and seeking a judgment of this Court to validate the proceedings for said Bonds, the revenues and funds pledged for the payment thereof, said obligations when issued pursuant thereto, and all matters connected therewith, and the Complaint now having been presented to this Court, for entry of an Order to Show Cause pursuant to Chapter 75, Florida Statutes, and the Court being fully advised in the premises:
IT IS ORDERED AND ADJUDGED that the State of Florida and the several taxpayers, property owners and citizens of the City of Madeira Beach, Florida, including nonresidents owning property subject to taxation therein, and all others having or claiming any right, title or interest in property to be affected by the issuance of the Bonds, as herein described, or to be affected in any way thereby, be and they are each hereby required to appear and show cause, if any there be, before the Honorable Anthony Rondolino on the 27th day of August, 2013, at 3:30 p.m. in Room 400 at the Pinellas County Courthouse in St. Petersburg, Florida, why the prayers of said Complaint should not be granted and why the proceedings for said Bonds and said Bonds when issued pursuant thereto and the revenues and funds pledged to the payment thereof and the legality of all matters in connection therewith should not be validated and confirmed as therein prayed.
AND IT IS FURTHER ORDERED AND ADJUDGED that this Order to Show Cause be published in the manner required by Section 75.06, Florida Statutes, in a newspaper of general circulation published in Pinellas County, Florida.
AND IT IS FURTHER ORDERED AND ADJUDGED that, by such publication of this Order, all taxpayers, property owners and citizens of the City of Madeira Beach, Florida, including non-residents owning property or subject to taxation therein and all others having or claiming any right, title or interest in the City of Madeira Beach, Florida, or the taxable property therein or in any property to be affected by the issuance of said Bonds or to be affected in any way thereby, or by the validity of such Bonds or of any revenues or funds pledged for payment thereof, or of the proceedings authorizing the issuance of said Bonds, be and they are made parties defendant to this proceeding, and that this Court shall have jurisdiction of them to the same extent as if named as defendants in said Complaint and personally served with process in this cause.
