NOTICE IS HEREBY GIVEN pursuant to an Order Rescheduling Foreclosure Sale filed May 17, 2013 and a Final Judgment dated September 29, 2010 entered in Civil Case No.: 36-2009-CA-063747 of the Circuit Court of the TWENTIETH Judicial Circuit in and for LEE COUNTY, Florida, wherein BAC HOME LOANS SERVICING, L.P. F/K/A COUNTRYWIDE HOME LOANS SERVICING, L.P., is Plaintiff, JOSE MARTES; ANA MARTES RODRIGUEZ A/K/A ANA MARTES RODRIGUEZ A/K/A ANA D. RODRIGUEZ A/K/A ANA RODRIGUEZ; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER, AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE , WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES OR OTHER CLAIMANTS; COUNTRYWIDE HOME LOANS INC; JOHN DOE 1, JANE DOE 1, JOHN DOE 2, JANE DOE 2, JOHN DOE 3, JANE DOE 3, JOHN DOE 4 AND JANE DOE 4 AS UNKNOWN TENANTS IN POSSESSION, are Defendants.
LINDA DOGGETT, the Clerk of Court shall sell to the highest bidder for cash online at www.lee.realforeclose.com at 9:00 a.m. on the 19th day of June, 2013 the following described real property as set forth in said Final Judgment, to wit:
LOTS 43, 44, 45, BLOCK 2008, UNIT 31, CAPE CORAL SUBDIVISION, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 14, PAGES 149, 165, INCLUSIVE, IN PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
