Notice is hereby given pursuant to an Order dated June 4, 2013, entered in Civil Case No. 2009-CA-006283 of the Circuit Court of the 20th Judicial Circuit in and for Charlotte County, Florida, wherein Deutsche Bank National Trust Company, as Trustee of the Residential Asset Securitization Trust 2004-A5, Mortgage Pass-Through Certificates, Series 2004-E under the Pooling and Servicing Agreement dated June 1, 2004, Plaintiff and Mortimer E. Francis a/k/a Mortimer Francis a/k/a Martin E. Francis and Pearl A. Francis a/k/a Perline Francis a/k/a Perline A. Francis, His Wife are defendant(s), I, Clerk of Court, Barbara T. Scott, will sell to the highest and best bidder for cash AT WWW.CHARLOTTE.REALFORECLOSE.COM IN ACCORDANCE WITH CHAPTER 45 FLORIDA STATUTES at 11:00AM on October 2, 2013, the following described property as set forth in said Final Judgment, to-wit:
LOT 3, BLOCK 4940, PORT CHARLOTTE SUBDIVISION, SECTION 93, A SUBDIVISION ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 9, PAGES 1A THROUGH 1Z4, OF THE PUBLIC RECORDS OF CHARLOTTE COUNTY, FLORIDA.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
