NOTICE IS HEREBY GIVEN pursuant to an Order dated June 4, 2013, entered in Civil Case No. 2010-CA-056235 of the Circuit Court of the 20th Judicial Circuit in and for Lee County, Florida, wherein BAC Home Loans Servicing, L.P. f/k/a Countrywide Home Loans Servicing, L.P., Plaintiff and Douglas E. Giering a/k/a Douglas Giering are defendant(s), I, Clerk of Court, Linda Doggett, will sell to the highest and best bidder for cash BEGINNING 9:00 A.M. AT WWW.LEE.REALFORECLOSE.COM IN ACCORDANCE WITH CHAPTER 45 FLORIDA STATUTES on July 5, 2013, the following described property as set forth in said Final Judgment, to-wit:
FAMILY UNIT 707, ACCORDING TO THE CONDOMINIUM DECLARATION FOR RIVERSIDE CLUB, AS SUCH CONDOMINIUM DECLARATION IS RECORDED IN THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA IN OFFICIAL RECORDS BOOK 250, PAGE 338, TOGETHER WITH AN UNDIVIDED 1/49 INTEREST IN THE COMMON AREAS AND FACILITIES AS DEFINED IN SAID CONDOMINIUM DECLARATION; AND TOGETHER WITH THE EXCLUSIVE RIGHT TO USE PARKING SPACE NUMBER RESTRICTED AREA 34, AS SHOWN ON THE PLANS ATTACHED TO SAID CONDOMINIUM DECLARATION.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
