NOTICE is hereby given that, pursuant to a Final Judgment entered April 18, 2013, in Case Number 12-013287-CI, in the Circuit Court of Pinellas County, Florida, the Clerk of Court shall offer for sale the property situate in Pinellas County, Florida, described as:
Lots 1, 2 and 3 in Block 3, HAVEN BEACH SUBDIVISION, as recorded in Plat Book 5, Page 27, of the Public Records of Pinellas County, Florida (except that part of said Lot 1 taken for road purposes by instrument filed October 16, 1954 as No. 311506A and instrument filed December 3, 1956 as No. 323135A in the Circuit Court of the Sixth Judicial Circuit, Pinellas County, Florida); and also including that part of Canal Avenue lying Northerly of and contiguous to said lots acquired pursuant to a decision in the Circuit Court of Pinellas County, Robert F. Starr v. City of Indian Rocks Beach (80-7901-10 Civil), and recorded in Official Records Book 5378, Pages 1612-1617, being more particularly described as follows:

Beginning at the Northwest corner of said Lot 1, said point being on the East right-of-way line of Gulf Boulevard (a 50.0 foot right-of-way); thence North 01 degrees 58' 00” East along the East right-of-way line of said Gulf Boulevard 101.78 feet to the Northerly line of said Canal Avenue; thence Southeasterly along said Northerly line, being a curved line having a radius of 50.00 feet and being concave Northeasterly an arc distance of 113.52 feet, chord bearing South 63 degrees 04' 39” East, 90.66 feet to the intersection of the Northeasterly line of said Lot 3 as extended Northwesterly; thence South 47 degrees 20' 24” East, along said Northeasterly line as extended 50.32 feet to the Northerlymost corner of said Lot 3; thence Southwesterly along the Northerly line of said Lots 3 and 2, being a curved line, having a radius of 100.00 feet and being concave Northerly an arc distance of 74.61 feet, chord bearing South 67 degrees 51' 06” West, 72.89 feet to a point of tangency; thence West along the North line of Lots 2 and 1, 53.46 feet to the Point of Beginning.

LESS portion deeded for Public Right-of-Way of C.R. 208 (Gulf Boulevard) in Official Records Book 6429, Page 1228, of the Public Records of Pinellas County, Florida.

Together with all right, title and interest in and to all existing or subsequently erected or affixed buildings, improvements and fixtures; all easements, rights of way, and appurtenances; all water, water rights, watercourses and ditch rights (including stock in utilities with ditch or irrigation rights); and all other rights, royalties, and profits relating to the real property including without limitation all minerals, oil, gas, geothermal and similar matters.

Together with the following:

1. All written and oral leases, mining or excavation agreements, or the like, and all rents, issues, profits, proceeds and revenues relating to or arising out of the Land or any improvements situated thereon.

2. Any and all surveys and all architectural and engineering plans, specifications and shop drawings, whether now existing or hereafter prepared, relating to any improvements constructed or to be constructed on the land or as appurtenances thereto.

3. Any and all building and other permits, licenses, approvals, agreements and commitments from any governmental or quasi-governmental authority or utility company, whether now or hereafter issued or obtained, relating to the land or any improvements constructed or to be constructed thereon or as appurtenances thereto.

4. Any and all warranties and guaranties covering any materials, fixtures, equipment or other items of personal property now or hereafter located on or placed in or used in connection with the land or any improvements constructed thereon.

5. Any and all contracts for the management, operation, development and maintenance of the project or any appurtenances thereto, whether now existing or hereafter made, executed or delivered; and

6. Any and all declarations of covenants, conditions and restrictions (or instruments of similar purpose or effect) affecting all or any part of the land, whether now existing or hereafter executed or recorded, including without limitation all of the right, title and interest of the declarant therein.

Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
