NOTICE IS HEREBY given pursuant to Final Judgment of Foreclosure dated February 27, 2013, and entered in Case No. 2009 CA 006871 NC of the Circuit Court of the 12th Judicial Circuit in and for Sarasota County, Florida, wherein National City Bank successor by merger to Deutsche Bank Trust Company Americas as Trustee Residential Funding Company, LLC FKA Residential Funding Corporation Attorney in Fact” 2007-QS1, is the Plaintiff and Thomas C. Fiorini; Holiday Apartments Condominium Association, Inc.; and Unknown Tenant(s) are the Defendants, the Clerk of Court will sell to the highest and best bidder for cash by electronic sale at www.sarasota.realforeclose.com beginning at 9:00 a.m. Eastern Time, on April 3, 2013, the following described property set forth in said Order or Final Judgment, to wit:
Apartment 312, Holiday Apartments, according to the Declaration of Condominium thereof recorded in Official Record Book 960, pages 1598 through 1647, as amended from time to time, and as per plat thereof recorded in Condominium Book 5, Page 31, as amended from time to time, of the Public Records, Sarasota County, Florida.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK OF COURT NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
