NOTICE IS HEREBY GIVEN that sale will be made pursuant to an Order or Final Summary Judgment. Final Judgement was awarded on February 14, 2013 in Civil Case No. 2012-CA-53090, of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein, BANK OF AMERICA, N.A., SUCCESSOR BY MERGER TO BAC HOME LOANS SERVICING, LP FKA COUNTRYWIDE HOME LOANS SERVICING LP is the Plaintiff, and, CONSTANCE A. SARRASIN; MARBELLA AT SPANISH WELLS III CONDOMINIUM ASSOCIATION, INC.; SPANISH WELLS COMMUNITY ASSOCIATION, INC.; MARBELLA AT SPANISH WELLS HOMEOWNERS ASSOCIATION, INC; AND UNKNOWN TENANT(S) IN POSSESSION are Defendants.
The clerk of the court will sell to the highest bidder for cash online at www.lee.realforeclose.com at 9:00 AM on May 29, 2013, the following described real property as set forth in said Final summary Judgment, to wit:
UNIT 4113, MARBELLA AT SPANISH WELLS III, A CONDOMINIUM ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED UNDER CLERK'S FILE NUMBER #2006000158772, AND ANY AMENDMENTS THEREOF; TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS DECLARED IN SAID DECLARATION OF CONDOMINIUM TO BE APPURTENANCE TO THE ABOVE DESCRIBED UNIT; SAID INSTRUMENTS BEING RECORDED AND SAID LAND SITUATE, LYING AND BEING IN LEE COUNTY, FLORIDA.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
