NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure dated March 7, 2013, and entered in Case No. 2011-CA-3763, of the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, wherein Capital One, N.A., is the Plaintiff and Jim Guy A/K/A James Guy, Diane M. Ruggerio, Michael Ruggerio, Carol Ruggerio, The Cottages at Naples Bay Resort Condominium Association, Inc., Tenant #1, Tenant #2, Tenant #3 and Tenant #4 are Defendants, The Clerk will sell to the highest and best bidder for cash at 11:00 a.m. on the 8 day of April, 2013, on the 3rd Floor Lobby of the Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples, Florida, 34112, the following described property as set forth in said Final Judgment, to wit:
UNIT C-102 OF THE COTTAGES AT NAPLES BAY RESORT, A CONDOMINIUM, (THE “CONDOMINIUM”) ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF (THE “DECLARATION”) RECORDED IN OFFICIAL RECORDS BOOK 4121, PAGES 3210 THROUGH 3362, INCLUSIVE, OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA, AS AMENDED, TOGETHER WITH THE FOLLOWING: (1) EXCLUSIVE RIGHT TO USE THE LIMITED COMMON ELEMENTS APPURTENANT TO UNIT C-102; AND (2) THE UNDIVIDED SHARE OF THE COMMON ELEMENTS OF THE CONDOMINIUM, DECLARED IN THE DECLARATION TO BE APPURTENANT THERETO.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within sixty (60) days after the sale.
