notice is hereby given that Sale will be made pursuant to an Order or Final Summary Judgment. Final Judgment was awarded on March 14, 2013 in Civil Case No.: 11-2010-CA-002925, of the Circuit Court of the TWENTIETH Judicial Circuit in and for COLLIER County, Florida, wherein, US BANK NATIONAL ASSOCIATION, AS SUCCESSOR BY TRUSTEE TO BANK OF AMERICA, NATIONAL ASSOCIATION, (SUCCESSOR BY MERGER TO LASALLE BANK NATIONAL ASSOCIATION) AS TRUSTEE FOR MORGAN STANLEY LOAN TRUST 2007-8XS is the Plaintiff, and, ARTHUR F. SMITH A/K/A ARTHUR SMITH; KARYN A. SMITH; JOHN DOE NKA JAVIER AVILEZ; JANE DOE NKA SIMONA BARBOZA; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISES, GRANTEES,OR OTHER CLAIMANTS are Defendants.
The clerk of the court, Dwight E. Brock, will sell to the highest bidder for cash At lobby on the third floor of the Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples FL 34112 at 11:00 am. on the 11 day of April, 2013, the following described real property as set forth in said Final Summary Judgment, to wit:
LOT 11, BLOCK 39, GOLDEN GATE, UNIT 2, ACCORDING TO THE PLAT THEREOF, OF RECORD IN PLAT BOOK 5, PAGES 65 THROUGH 77, OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
