notice is hereby given pursuant to an Order or Final Judgment of Foreclosure dated January 28, 2013, and entered in Case No. 2009CA004614 of the Circuit Court of the 20TH Judicial Circuit in and for COLLIER County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF CWMBS, INC., CHL MORTGAGE PASS-THROUGH TRUST 2007-J1 MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2007-J1 is the Plaintiff and SCOTT A. BERGER and MICHEL L. BERGER and SATURNIA LAKES HOMEOWNERS ASSOCIATION, INC. and MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. the Defendants, I will sell to the highest and best bidder for cash on the third floor lobby of the Collier County Courthouse Annex, 3315 Tamiami Trail East, Naples, FL 34112, at 11:00 A.M. on the 28 day of May, 2013, the following described property as set forth in said Order of Final Judgment, to wit:
LOT 362, SATURNIA LAKES- PLAT ONE, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 36, AT PAGE 56 OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK OF COURT NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
