NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale dated the 4th day of April, 2013, and entered in Case No. 48-2010-CA-004703 O, of the Circuit Court of the 9TH Judicial Circuit in and for Orange County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK,AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF THE CWALT, INC., ALTERNATIVE LOAN TRUST 2006-39CB, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2006-39CB is the Plaintiff and GORDON MCDOUGALL, GORDON MCDOUGALL, GORDON MCDOUGALL, MIRIADA CONDOMINIUM ASSOCIATION, INC. and UNKNOWN TENANT(S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The foreclosure sale is hereby scheduled to take place on-line on the 6th day of June, 2013 at 11:00 AM at www.myorangeclerk.realforeclose.com. The Orange County Clerk of Court shall sell the property described to the highest bidder for cash after giving notice as required by section 45.031, Florida statutes, as set forth in said Final Judgment, to wit:
UNIT S BUILDING 2035, MIRIADA CONDOMINIUM ACCORDING TO THE DECLARATION OF CONDOMINIUM RECORDED IN OFFICIAL RECORD BOOK 8595, PAGE 1954 OF THE PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA. TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
