NOTICE IS HEREBY GIVEN pursuant to a Final Judgment dated May 13, 2013, entered in Civil Case No.: 08-2012-CA-002821, of the Circuit Court of the Twentieth Judicial Circuit in and for Charlotte County, Florida, wherein GMAC MORTGAGE, LLC (SUCCESSOR BY MERGER TO GMAC MORTGAGE CORPORATION), is Plaintiff, and MOSES V. RIVERA; UNKNOWN SPOUSE OF MOSES V. RIVERA; MARITZA PEREZ; STATE OF FLORIDA DEPARTMENT OF REVENUE; THE CLERK OF THE CIRCUIT COURT FOR CHARLOTTE COUNTY, FLORIDA; UNKNOWN TENANT #1; UNKNOWN TENANT #2; ALL OTHER UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER, AND AGAINST A NAMED DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAME UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS, are Defendant(s).
BARBARA T. SCOTT, the Clerk of Court shall sell to the highest bidder for cash at 11:00 a.m., online at www.charlotte.realforeclose.com in accordance with Chapter 45 Florida Statutes, on the 9 day of August, 2013 the following described real property as set forth in said Final Judgment, to wit:
LOT (S) 14, BLOCK 2164, PORT CHARLOTTE SUBDIVISION, SECTION 37, ACCORDING TO THE PLAT THEREOF, RECORDED IN PLAT BOOK 5, PAGE(S) 41A THROUGH 41H, OF THE PUBLIC RECORDS OF CHARLOTTE COUNTY, FLORIDA.
This property is located at the Street address of: 4461 BRINTNALL STREET, PORT CHARLOTTE, FL 33948.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
